RESOLUTION 1996-07
 
TOWN OF GRANT
WASHINGTON COUNTY, MINNESOTA
 
WHEREAS, Mr. Michael Harris is the owner of a parcel of land located at 10241 83rd Street North in Grant Township,
Washington County, Minnesota; and, legally described on the attached Exhibit ~A"; and,
WHEREAS, Mr. Harris has applied to the Township for a variance to build a garage fifteen (15) feet from the right-of-way of
83rd Street North instead of the required sixty-five (65) foot road setback requirement found in the Ordinance; and,
 
WHEREAS, following a public hearing on the Application, the Grant Township Planning Commission has recommended granting
a variance; and,
 
WHEREAS, the Town Board of the Town of Grant finds that a variance is appropriate because there is a hardship on the subject
property due to the limited buildable area on the lot, the septic system location, and the fact that there is no other location on the
parcel adequate for a garage.
 
NOW THEREFORE, be it resolved by the Board of Supervisors of the Town of Grant as follows:
 
1.  The Applicant is granted a variance from the required setback of sixty-five (65) feet from 83rd Street North to a setback of
fifteen (15) feet for the purpose of constructing a new garage.  Said variance is granted subject to the following conditions:
 
                    A.      The garage is not to be built any closer to 83rd Street North than the existing garage.
 
                    B.      Washington County inspectors will verify that the proposed addition will not impact the existing
                    septic system or potential location for a replacement system.
 
Adopted by the Town Board of the Town of Grant this 6th day of February, 1996.

All that part of the East Half of the Northwest Quarter of the
Southwest Quarter (E1/2 of NW1/4 of SW1/4) of Section 23, Township 30
North, Range 21 West, described as follows:
 
       Commence at the Northeast corner of the NW1/4 of SW1/4 of Section 23, Township 30 North, Range 21 West; thence
       South along the East line of said NW1/4 of SW1/4 for 1,025 feet to the centerline of public highway, the point of
       beginning of this description; thence North 83 degrees 25' West for 386.2 feet along said centerline of public highway;
       thence South 84 degrees 12' West for 265.7 feet along said centerline of public highway; thence South 2 degrees 36'
       East for 332.2 feet to the centerline of public road; thence Easterly along said centerline of public road for 646.8 feet,
       more or less, to the East line of said NW1/4 of SW1/4 of Section 23, Township 30 North, Range 21 West; thence North
       along said East line of NW1/4 of SW1/4 of Section 23, for 250.2 feet to the point of beginning.
