RESOLUTION 1996-08
TOWN OF GRANT
WASHINGTON COUNTY, MINNESOTA
WHEREAS, Mr. Gene C. Witte is the owner of a parcel of land located
at 7350 Keats Avenue North, Stillwater1 Minnesota
55082, and legally described as:
The South 330.00 feet of the North 990.00 feet of the East 693.00 feet
of the Northeast Quarter of the Southeast
Quarter of Section 27, Township 30 North, Range 21 West, Grant Township,
Washington County, Minnesota.
Containing 5.25 acres, more or less, subject to the right-of-way of
Keats Avenue North
and,
WHEREAS, Mr. Witte has applied to the Township for a variance to build
a 30 foot by 32 foot metal-sided accessory building
closer to the front lot line than the principal building; and,
WHEREAS, Mr. Witte has also requested a variance from the twenty (20)
foot setback requirement so as to allow the accessory
structure to be built ten (10) feet back from the side yard lot line;
and,
WHEREAS, following a public hearing on the application, the Grant Township
Planning Commission has recommended granting
a variance with conditions; and,
WHEREAS, the Town Board of the Town of Grant finds that a variance
is appropriate because there is a hardship on the subject
property due to the limited buildable area on the lot where an accessory
building could be located. Specifically, the area proposed
for construction of the accessory building is the best location on
the parcel to build the structure.
NOW, THEREFORE, be it resolved by the Board of Supervisors of the Town
of Grant as follows:
1. The Applicant is granted a variance so as to allow him
to construct an accessory building closer to the front lot line than the
principal building. Said variance is granted subject to the following
conditions:
a. The
accessory building is not to be built any closer than ten (10) feet from
the side yard
setback.
b. The
color of the building shall be an earth tone and be agreeable with Mr.
Witte's neighbor,
who attended the meeting.
Adopted by the Town Board of the Town of Grant this 7th day of May,
1996.
