RESOLUTION 1996- 10

TOWN OF GRANT
WASHINGTON COUNTY, MINNESOTA
 

A RESOLUTION OF THE TOWN BOARD REQUESTING THAT THE WASHINGTON COUNTY SOIL AND WATER
CONSERVATION DISTRICT PROVIDE STUDY AND DESIGN SERVICES TO HELP SOLVE THE FLOODING PROBLEM IN
THE KISMET BASIN.

WHEREAS, the Town of Grant is a statutory town with the powers given to towns by virtue of Minnesota Statutes Chapter 444.16,
et. seq., to establish Storm Sewer Improvement Tax Districts; and,

WHEREAS, Minnesota Statutes §444.17 provides that an Ordinance establishing a Storm Sewer Improvement Tax District must
“describe with particularity the territory or area within the municipality to be included within the District;” and,

WHEREAS, it has become known to the Town that the Washington County Soil and Water Conservation District may be willing to
provide surveying, study and design services for such a District at no cost to the Town; and,

WHEREAS, the Washington County Soil and Water Conservation District will not provide any services until they have received a
request which they can review and either approve or deny.

NOW, THEREFORE, based upon the foregoing, the following Resolution was duly made, seconded and approved:

1. That the Town of Grant, Washington County, Minnesota hereby requests that the Washington County Soil and Water Conservation
District (or its federal or state counterpart agencies) provide the Town with surveying, study and design services to assist the Town in
the possible establishment of a Chapter 444 Storm Sewer Improvement Tax District.

2.  The Town specifically requests the following services to be provided by the Soil and Water Conservation District:

                    a.       A delineation describing with particularity the territory or area within the Township to be included
                    within the District.

                    b.       A preliminary report or study advising the Town as to:

                          1.       Whether the proposed improvement is feasible;

                          2.       Whether it should be made as proposed or in connection with some other improvement;

                          3.       The estimated cost of the improvement; and,

                          4.       A proposed method for assessing the cost of the study and any proposed improvement
                          projects upon the lands within the area delineated as being within the District.
