RESOLUTION 1997-5

CITY OF GRANT
WASHINGTON COUNTY, MINNESOTA

A RESOLUTION REQUESTING THAT WASHINGTON COUNTY ASSUME RESPONSIBILITY FOR THE CONSTRUCTION AND
MAINTENANCE OF A STORMWATER CONTROL OUTLET TO CONTROL THE FLOODING OF THE KISMET DRAINAGE
BASIN.

WHEREAS, since the late 1980s, the area known as "Kismet Basin" has experienced increased water elevations; and,

WHEREAS, in the summer of 1995 and 1996, the surface water level in the basin exceeded the lake's ordinary high water level.  Area
homes have been inundated with water, septic Systems have been flooded, the stability of local roads has  been undermined, and
existing drainage patterns in the area have been disrupted; and,

WHEREAS, the flood waters have not substantially receded since 1995 causing concern that future storm water run-off will
compound already high water levels and causing a danger to the public health, safety and welfare in that area; and,

WHEREAS, the Washington County Soil and Water Conservation District has completed a feasibility study determining that
an outlet could be constructed from the Kismet Basin to Brown's Creek for eventual discharge into the St. Croix River.  This
would have the end effect of reducing the flood waters in the Kismet Basin; and,

WHEREAS, the studies of the Washington County Soil and Water Conservation District have concluded that the construction of such
an outlet would not adversely affect other property owners or the environment, or cause any negative downstream effects; and,

WHEREAS, construction of the outlet to Brown's Creek may require obtaining drainage easements outside of the municipal
boundaries of the City of Grant; and,

WHEREAS, with the dissolution of the Brown's Creek Water Management Organization, the responsibility for surface water
management within that former watershed rests with Washington County; and,

WHEREAS, it appears that there are no funding sources available for this project outside of a Chapter 444 Storm Sewer Improvement
District.

NOW, THEREFORE, be it resolved by the City Council of the City of Grant, Washington County, Minnesota, that it appears
necessary, in the interests of public health, safety and welfare, to construct an outlet from the Kismet Basin to alleviate and control
flood waters in that basin in order to protect homes, roads, septic systems, and to improve the overall drainage quality in that area.

FURTHERMORE, the Washington County Board of Commissioners, serving as the water management organization for the Brown's
Creek Watershed, is hereby requested to construct and maintain the proposed outlet from the Kismet Basin as soon as practical.

FURTHERMORE, the City believes that the most timely, practicable and equitable method for funding such an improvement is
through assessments levied on the contributing area under Minnesota Statutes Chapter 444.

FURTHERMORE, the Grant City Council hereby requests that the Washington County Board of Commissioners, when calculating out
the total project costs to be assessed in this matter, include in those assessments (and reimburse to the City of Grant) all costs
incurred by the City of Grant in bringing the Kismet Basin project forward to this point.

WHEREUPON, said Resolution was declared passed and adopted this 1st day of April, 1997.
