RESOLUTION 1997-9

CITY OF GRANT
WASHINGTON COUNTY, MINNESOTA

WHEREAS, Mr. Andrew S. Leach is the owner of a parcel of land located at 9696 Dellwood Road North in the City of Grant,
Washington County, Minnesota, legally described as: Lot 8, Block 3, Victoria Station No. 3, Washington County, Minnesota and,

WHEREAS, Mr. Leach has applied to the City for a variance to build a 24 feet by 30 feet detached garage closer to the front lot line
than the principal building; and,

WHEREAS, following a public hearing on the application, the City of Grant Planning Commission has recommended denial of the
variance; and,

WHEREAS, the City Council of the City of Grant finds that a variance is appropriate because there is a hardship on the subject
property due to the location of the existing well, the existing septic system, existing in-ground sprinkler system, existing landscaping,
and because of the "view lines'1 which would be disturbed if the garage were built in a different location. Specifically, the garage as
proposed would be in view of only one of the neighboring properties. If it were placed behind the home, six (6) property owners
would be affected by the existence of the new garage. Additionally, the area proposed for construction of the garage is the best
location on the parcel to build the structure.

NOW, THEREFORE, be it resolved by the City Council of the City of Grant as follows:

   1.       The Applicant is granted a variance so as to allow him to construct an accessory building closer to the front lot line than the
      principal building.  Said variance is granted subject to the following conditions:

  a. The new garage shall be built in such a fashion and in such a style as compliments the house. Specifically, the structure shall be
  built according to the plans represented to the Planning Commission and City Council.

Adopted by the Town Board of the Town of Grant this 1st day of July 1997.
