CITY OF GRANT
WASHINGTON COUNTY1 MINNESOTA
 
WHEREAS, Rick and Karen Bisson are the owners of property located south of 114th Street North, and north of Benz Lake in the City
of Grant1 Washington County, Minnesota; and,
 
WHEREAS, the property is legally described as follows:
 
          See Attached Exhibit “A" and,
 
WHEREAS, the Bisson's have applied to the City for a variance to build a home seventy-five (75) feet from the lake setback
requirement rather than the required two hundred (200) feet setback requirement found in the Ordinance; and,
 
WHEREAS, following a public hearing on the application, the Grant Planning Commission has recommended granting the variance;
and,
 
WHEREAS, the City Council finds that a variance is appropriate because there is a hardship on the subject property due to the limited
buildable area on the lot.  The only other places available on the lot are areas which are simply too low (in fact lower than the level of
the lake) , or areas which are on a high ridge.  It appears that the only feasible location for the home is in its proposed location.
 
NOW THEREFORE, be it resolved by the City Council of the City of Grant, Washington County, Minnesota as follows:
 
1.  The Applicant is granted a variance from the required setback of two hundred (200) feet from the lake to a setback of seventy-five
(75) feet for the purpose of constructing a home and septic system.  This variance is granted subject to the following conditions:
          A.                    Mr. and Mrs. Bisson must meet all five (5) of the conditions recommended by the City's Planner in his
          report.
 
          B.         The surface water drainage system for the lot near the septic system must be established in such a way that the
                water is directed to the north, away from Benz Lake.
 
Adopted by the City Council of the City of Grant this 2nd day of June, 1998.

         Thence continuing South 89°58'27" East along said South line of the Northwest Quarter of the Southeast Quarter (NW1/4
         of SEI/4) for Three Hundred (300.00) feet; thence North 9°34'50" West for Eight Hundred Sixty- four and Seven teen
         Hundredths (864.17) feet to the centerline of 114th Street North; thence Westerly along said centerline of 114th Street
         North on a non-tangential curve, concave to the South, having a central angle of 12°40'4” and a radius of 1268.73 feet,
         the chord of which bears North 84°33'25” West  for an arc distance of Two Hundred Eighty and Seventy-four Hundredths
         (280.74) feet; thence tangentially South 89°06'15" West along said centerline of 114th Street North for Nineteen and
         Twenty-six Hundredths (19.26) feet; thence South 9°11'03" East for Eight Hundred Eighty-nine and Sixty-seven
         Hundredths (889.67) feet to the point of beginning.
