WASHINGTON COUNTY, MINNESOTA
 
 
RESOLUTION VACATING CERTAIN DRAINAGE AND UTILITY EASEMENTS IN MANN
LAKE ESTATES IN EXCHANGE FOR THE RECEIPT OF NEWLY CONFIGURED
DRAINAGE AND UTILITY EASEMENTS
 
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRANT, WASHINGTON COUNTY, MINNESOTA, AS
FOLLOWS:
 
WHEREAS, Randy S. Stockman and Elizabeth A. Stockman, husband and wife, have petitioned the City to vacate certain drainage
and utility easements being described specifically as follows:
 
The easterly 10 feet of the northerly 355.00 feet of the southerly 365.00 feet of Lot 3 and the westerly 20 feet of the northerly 355.00
feet of the southerly 365.00 feet of Lot 2, all in Block 2, MANN LAKE ESTATES
 
The easterly 5 feet of the northerly 365.23 feet of the southerly 375.23 feet of Lot 3, Block 2, MANN LAKE ESTATES 2ND
ADDITION.
 
and,
 
WHEREAS, in exchange for the vacation of the above-described easements, Randy S. Stockman and Elizabeth A. Stockman, husband
and wife, will in exchange dedicate to the City perpetual drainage and utility easements as follows:
 
             The easterly 10 feet of the westerly 200.00 feet of the southerly 325 feet and the easterly 10 feet of the westerly
             210.00 feet of the southerly 325 feet of Lot 3, Block 2, MANN LAKE ESTATES.
 
             A strip of land 20 feet in width being 10 feet on each side of the following described center line to wit:
             Commencing at the southeast corner of Lot 2, Block 2, MANN LAKE ESTATES; thence South 34 degrees
             35 minutes 28 seconds West, assumed bearing, along the southeasterly line of said Lot 2, a distance of 115.00
             feet to the point of beginning of the center line to be described; thence North 26 degrees 30 minutes West a
             distance of 70.00 feet; thence North 84 degrees 10 minutes 11 seconds West a distance of 165.00 feet;
             thence North 60 degrees 27 minutes 29 seconds West a distance of 110.00 feet and there terminating.
 
WHEREAS, said vacation and rededication of public drainage and utility easements are necessary due to a rearrangement of lots
within said Mann Lake Estates.  Said vacation of the old easements allows the Stockmans to build upon the newly configured lots.
The rededication of the new easements provides the City with the drainage and utility easements that it needs; and,
 
WHEREAS, for the foregoing reasons it appears to be in the public's best interest to vacate that portion of the existing drainage and
utility easements in order to obtain the new drainage and utility easements; and,
 
WHEREAS, the Council has determined that the Stockmans' payment of the costs incurred within these proceedings, together with
the dedication of additional easements as noted above is sufficient consideration for the vacation of the property sought to be vacated.
 
NOW, THEREFORE, based upon the foregoing, the following Resolution was duly made, seconded and approved:
 
1.  That the following described drainage and utility easements are hereby vacated:
 
The easterly 10 feet of the northerly 355.00 feet of the southerly 365.00 feet of Lot 3 and the westerly 20 feet of the northerly 355.00
feet of the southerly 365.00 feet of Lot 2, all in Block 2, MANN LAKE ESTATES.
 
The easterly 5 feet of the northerly 365.23 feet of the southerly 375.23 feet of Lot 3, Block 2, MANN LAKE ESTATES 2ND
ADDITION.
 
2.  That the City Clerk shall prepare a Notice of Completion of these proceedings which shall contain the name of the City, the
identification of the vacation, a statement of the time of the completion thereof, and a description of the real estate and land affected
thereby.  Such notice shall be presented to the County Auditor, who shall enter the same in his transfer records and note upon the
instrument over his official signature the words "entered into the transfer records."  The notice shall then be filed with the County
Recorder, all as is required by Minnesota Statutes §412.851.
 
   3.      That a true and correct survey of the area depicted as being vacated is annexed hereto as Exhibit '1A" and
      incorporated herein by reference, that survey being prepared by Carlson & Carlson, Inc. dated October 2, 1997.
 
WHEREUPON, a vote being taken upon the motion, said motion was passed by a majority of the City Council members.
 
WHEREUPON said motion was declared duly passed on the 10th day of March, 1998.
