RESOLUTION 1998-07
CITY OF GRANT
WASHINGTON COUNTY, MINNESOTA
 
WHEREAS, Daniel & Diana Borash are the owners of a parcel of land located at 8765 Kimbro Avenue North in the City of Grant,
Washington County, Minnesota, legally described as:
 
         See:                 Attachment A and,
 
WHEREAS, the Borash's have applied for a variance to build a detached garage closer to the front lot line than the principal building;
and,
 
WHEREAS, following a public nearing, the Planning Commission has recommended approval of the variance; and,
 
WHEREAS, the City Council finds that a variance is appropriate because there is a hardship on the property.  Specifically, the property
is laid out so that there is no other feasible place on the lot to build the accessory structure.  Other possible areas are already occupied
by the home, the swimming pool, the drain field, the drain tile, or very heavily wooded areas.  It would be possible to build the
accessory building in another location, but that would require a second driveway onto another road.  Additionally, the location selected
is well screened so as to not be visible to neighboring properties.
 
NOW, THEREFORE, be it resolved by the City Council of the City of Grant as follows:
 
         1. The Applicants are granted a variance so as to allow them to construct an accessory building closer to the front lot line
         than the principal building.  Said variance is granted subject to the following conditions:
 
                           a. The new garage shall be built in a similar color and style to the home.

Minnesota, described as follows to wit:
beginning at the southwest comer of the northwest 1/4 of the northeast 1/4 of section 23, Township 30 north, Range 21 west,
thence east along the south line of said northwest 1/4 of the northeast 1/4 428.07 feet to an iron stake; thence on a line
parallel to the west line of said northwest 1/4 of northeast 1/4 a distance of 365.6 feet to the centerline of Washington
County road 23; thence along centerline of said road to a point: on the west line of said northwest 1/4 of northeast 114402.6
feet north of the point of beginning; thence south along the west line of said northwest 1/4 of northeast 1/4 to the point of
beginning.
