RESOLUTION 1999-01
CITY OF GRANT
WASHINGTON COUNTY, MINNESOTA
WHEREAS, Ms. Patricia Terry and Ms. Virginia Merrill (hereinafter referred
to as "the Applicant") have applied to the City of Grant
for a minor subdivision related to land located at 7395 Ideal Avenue
North, City of Grant, and legally described as:
See:
Attachment A and,
WHEREAS, the Applicant's property is approximately 20.8 acres in size;
and,
WHEREAS, the Applicant would like to divide the parcel into two (2)
lots as follows:
Tract A - 14.8 acres Tract B - 6.0 acres
and,
WHEREAS, Tract A has necessary road frontage along County State Aid
Highway No. 12, and along Ideal Avenue North. Tract B has
the required amount of road frontage along Ideal Avenue North; and,
WHEREAS, the Applicant appeared before the City Planning Commission
on December 28, 1998. The City Planning Commission
recommended approval of this minor subdivision subject to conditions;
and,
WHEREAS, the Applicant appeared before the Grant City Council on February
2, 1999. The entire City Council was in attendance at
the meeting
NOW, THEREFORE, based upon all of the files, records and proceedings
herein, and based upon a motion duly made, seconded and
unanimously approved, be it resolved by the City Council of the City
of Grant as follows:
1. The minor subdivision request of the Applicant is hereby approved
subject to the following conditions:
a. Applicant
submits to the City's Engineer for review and approval a topographic survey
at two foot
contour intervals containing the information requested in the Engineer's
Memorandum dated December 28,
1998.
b. Applicant
submits a Certificate of Survey identifying the limits of utility and drainage
easements for
Tract A and Tract B.
c. Applicant
posts a One Thousand Dollar ($1,000.00) cash escrow with the City in order
to
guarantee that the existing pole barn shown on the proposed Tract A be
reduced in size so that it not exceed
Two Thousand Five Hundred (2,500) square feet. The pole barn shall
be so reduced in size no later than
July 15, 1999. If it is not reduced in size, then the City is authorized
to draw upon the cash escrow, order
the work done, go upon the Applicant's property, and reduce the size of
that structure.
d. Applicant
delivers to the City Deeds conveying such utility such utility, drainage
and right-of-way
easements as are required by the City Engineer.
WHEREUPON, the foregoing Resolution was approved ~his 2nd day of February,
1999.

of Section 28, Township 30, Range 21, Washington county,
Minnesota lying north of the south 869.00 feet lying south of the center
line of county State Aid Highway No. 12 as now laid out and
traveled and except the east 200.00 feet of said West Half of the West
Half of the Southwest Quarter lying north of the south 1705.07
feet of said West Half of the West half of the Southwest Quarter as
measured along the east line thereof. Except the west 33.00 feet
of said West Half of the West Half of the Southwest Quarter.
Subject to the right-of-way of county State Aid Highway No. 12 as
now laid out and traveled along the north line of said Southwest Quarter,
Washington county, Minnesota
