RESOLUTION 1999-09

CITY OF GRANT
WASHINGTON COUNTY, MINNESOTA

WHEREAS, Mark and Jean Hollerman are the owners of a parcel of land located at 8960 107th Street North, Stillwater,
Washington County, Minnesota, legally described as:

             Lot 5, Block 1, Kendrick Estates, Washington County, Minnesota;

and,

WHEREAS,  the Hollermans have applied to the City for a variance to build a detached garage closer to the front lot line than the
principal building; and,

WHEREAS, following a public hearing, the Planning Commission has recommended approval of the variance; and,

WHEREAS, the City Council finds that a variance is appropriate because there is a hardship on the property.  Specifically, the
property is laid out so that there is no other feasible place on the lot to build the accessory structure.  Specifically, the layout of the
home and existing garage on the property leave this proposed site as the only logical choice.  Any other choice would require the
drain field or septic system to be intruded upon.

NOW, THEREFORE, be it resolved by the City Council of the City of Grant as follows:

1. The Applicants are granted a variance so as to allow them to construct an accessory building closer to the front lot line than the
principal building.  Said variance is granted subject to the following conditions:

                    a.          The new structure shall be built in a similar color and material to the home.

                    b.          The new structure shall not be built any higher than the existing home.

                    c.          The Building Official shall review all plans before issuing the Building Permit.

Adopted by the City Council of the City of Grant this 5th day of October, 1999.

Gary Erichson, Mayor
